Steve Bliss: Well, a Revocable Living Trust allows you to maintain control over your assets during your lifetime while also ensuring they are distributed according to your wishes after you pass away. Think of it like a safety net for your loved ones.

You get to decide who inherits what, when they inherit it, and even under what conditions. This flexibility is a major draw for many people.

Moreover, because assets held in a Revocable Living Trust avoid probate, the process of transferring them to beneficiaries is typically much smoother and faster than it would be if there was no trust in place.

Consequently, your loved ones are spared the time, expense, and public scrutiny that often accompany probate court proceedings.

Reporter: That’s certainly compelling. Are there any potential downsides to using a Revocable Living Trust?

Steve Bliss: It’s important to remember that every situation is unique. While Revocable Living Trusts offer significant benefits, they aren’t necessarily the right solution for everyone.

For example, if you have a relatively simple estate and your assets are already jointly owned with your spouse or other beneficiaries, a will may be sufficient.

Conversely, if you have complex financial holdings or anticipate potential challenges among your heirs, a Revocable Living Trust can provide much-needed clarity and protection.

Notwithstanding those drawbacks, probate isn’t always avoidable. For instance, assets held solely in your name and not within a trust will typically have to go through probate.

But by placing your assets into a Revocable Living Trust during your lifetime, you can ensure they transfer directly to your designated beneficiaries without going through the probate process.

This saves time and money for your loved ones during an already difficult period.

Reporter: Steve, in your experience working with clients on estate planning, have there ever been any issues or complications that arose from using a Revocable Living Trust?

Steve Bliss: While I always aim to make the process as smooth and straightforward as possible, there are occasions where unforeseen circumstances can arise.

I recall working with a client who had established a Revocable Living Trust many years ago but hadn’t updated it after a significant life event—namely, the birth of their grandchild.

The original trust document didn’t include any provisions for this new family member, leading to some confusion and potential legal complexities down the road.

Thankfully, we were able to amend the trust to ensure the grandchild was properly included as a beneficiary.
