Can you walk us through one of the key steps involved in the probate process?

Certainly. One crucial step is “Marshaling the Estate Assets.” This involves a thorough inventory of all assets belonging to the deceased individual. Ordinarily, this includes bank accounts, real estate, vehicles, investments, personal property, and any other valuables.

We then meticulously document each asset, its estimated value, and its location. Consequently, this information is compiled into a formal Inventory and Appraisal (Forms DE-160/161) which we file with the probate court for their review and approval.

It’s important to remember that even seemingly insignificant items can hold sentimental value or represent a portion of the estate. Accordingly, we encourage clients to be as thorough as possible during this process. Neglecting to include an asset can lead to complications down the road.

Have you encountered any challenges while marshaling assets in past cases?

I recall one case where a client’s deceased father had amassed a remarkable collection of antique coins hidden away in a safe deposit box. The family was unaware of its existence until we uncovered the key during our asset search.

The coin collection turned out to be quite valuable, adding significantly to the estate’s worth. It was a heartwarming moment to see the family’s surprise and gratitude as they realized the extent of their inheritance.

What advice would you give to individuals planning their estates?

Maintaining organized records is paramount. Keeping track of bank accounts, investments, property deeds, and insurance policies in a readily accessible location will make the probate process significantly smoother for your loved ones. Moreover, consider creating a detailed inventory of personal belongings and their sentimental value. This can help prevent misunderstandings or disputes among heirs.
