What inspired you to focus on elder law?

Well, it wasn’t a sudden epiphany. My path was more of a gradual realization. As I gained experience in general legal practice, I found myself increasingly drawn to cases involving vulnerable adults. The complex challenges they face – financial exploitation, healthcare neglect, even emotional abuse – truly resonated with me.

Seeing firsthand the devastating impact these issues have on seniors and their families solidified my decision to dedicate my practice to elder protection. There’s a profound sense of purpose in advocating for those who may not be able to advocate for themselves.

Could you walk us through one of the key steps in the elder protection process?

Let’s dive into “Case Assessment.” It’s crucial because it sets the stage for everything that follows. Imagine a detective meticulously analyzing clues at a crime scene – that’s what we do during this phase.

  • First, we need to pinpoint the legal issue at hand: Is this a case of financial exploitation? Physical abuse? Neglect?
  • Next comes identifying the relevant laws and jurisdictions. Elder law can be surprisingly complex, with different regulations depending on where the client resides.

Then, we gather evidence like interviewing the elder, potential witnesses, and reviewing medical or financial records. Think of it as piecing together a puzzle. Every piece of information brings us closer to understanding the situation and formulating an effective strategy for protection.

Have there ever been any hiccups during this stage that you recall?

There was one case that stands out. A senior gentleman, let’s call him Mr. Jones, suspected his caregiver of stealing money. On paper, it looked straightforward. But when we started digging deeper, the evidence wasn’t as clear-cut as we initially thought.
