- If so, we file a petition with the court, asking to be appointed as the executor or administrator.
- Then comes notification – publishing notices in the newspaper, mailing them to heirs and beneficiaries, even alerting known creditors.
- Next up is a court hearing where a judge reviews the petition and addresses any objections.
- “Once we get the green light from the judge, we gather all the estate assets, inventory them, and file an appraisal with the court.
- Step six involves handling debts and taxes. We pay valid claims and ensure all necessary taxes are filed and paid.
How does the distribution process work?
“Finally, we prepare a detailed accounting of everything that’s happened, get court approval, and then distribute the remaining assets to the rightful heirs or beneficiaries. That’s it – the estate is settled, and we can close probate!”

“Ah, debts and taxes – never a fun topic! But they are crucial to ensure everything is handled fairly and legally. One of the biggest challenges is identifying all valid creditor claims. Sometimes, creditors come out of the woodwork long after someone has passed away.
"It’s important to be thorough and methodical in reviewing financial records, reaching out to potential creditors, and carefully evaluating each claim. We need to ensure only legitimate debts are paid and that the estate is protected from fraudulent claims."
