  • Determine If Probate Is Necessary: This first step is crucial. We look at the value of the estate – anything above $184,500 typically requires probate – and identify assets that aren’t subject to probate, like those held in trusts or through joint tenancy.
  • File Petition for Probate: This involves submitting a formal petition (Form DE-111) to the county court requesting appointment as executor or administrator. We also submit the original will, if there is one.
  • Provide Notice: Transparency is key! We publish notice of the probate in a local newspaper three times and mail notices to heirs and beneficiaries. Known creditors are also notified formally.

Can you elaborate on handling debts and taxes – step VI in the process?

“It’s like untangling a knot, but one with legal and financial implications,” Ted explains. “We meticulously review all creditor claims, verifying their validity and prioritizing them according to state law. Then comes the tax dance: filing both state and federal tax returns for the decedent’s final year, ensuring all obligations are met before distribution.”

“Paying off legitimate debts is crucial,” Ted emphasizes. “It respects the decedent’s wishes and protects the beneficiaries from future liability.”

Ted goes on to describe a situation where a beneficiary attempted to hide debt owed by the deceased, leading to legal complications and delayed distribution of assets.

“Transparency and honesty are paramount in probate,” Ted stresses. “Attempting to deceive the court can result in severe consequences for everyone involved.”
